{"id":3659,"date":"2025-05-08T07:02:22","date_gmt":"2025-05-08T07:02:22","guid":{"rendered":"https:\/\/mailitics.com\/index.php\/2025\/05\/08\/uh-uh-not-guilty\/"},"modified":"2025-05-08T07:02:22","modified_gmt":"2025-05-08T07:02:22","slug":"uh-uh-not-guilty","status":"publish","type":"post","link":"https:\/\/mailitics.com\/index.php\/2025\/05\/08\/uh-uh-not-guilty\/","title":{"rendered":"Uh-Uh, Not\u00a0Guilty"},"content":{"rendered":"<p>    Uh-Uh, Not\u00a0Guilty<br \/>\n \t<BR><br \/>\n<BR><\/BR><br \/>\n    <!-- no image --><br \/>\n \t<BR><br \/>\n<BR><\/BR><\/p>\n<div>\n<p class=\"wp-block-paragraph\"><mdspan datatext=\"el1746667449210\" class=\"mdspan-comment\">When the six<\/mdspan> merry murderesses of the Cook County Jail climbed the stage in the Chicago musical, <a href=\"https:\/\/www.youtube.com\/watch?v=C1VVB_9nCmg&amp;ab_channel=ED5International\" target=\"_blank\" rel=\"noreferrer noopener\">they were aligned on the message<\/a>:\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">They had it coming, they had it coming all along.\u00a0<br \/>I didn\u2019t do it.\u00a0<br \/>But if I\u2019d done it, how could you tell me that I was wrong?<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">And the part of the song I found interesting was the reframing of their violent actions through their moral lens: \u201c<em>It was a murder, but not a crime.<\/em>\u201d<\/p>\n<p class=\"wp-block-paragraph\">In short, the musical tells a story of <a href=\"https:\/\/www.loreto.ac.uk\/chicago-the-musical\/#:~:text=greed%2C%20murder%20and%20injustice\" rel=\"noreferrer noopener\" target=\"_blank\">greed, murder, injustice<\/a>, and <strong><a href=\"https:\/\/towardsdatascience.com\/tag\/blame-shifting\/\" title=\"Blame-shifting\">Blame-shifting<\/a> plots<\/strong> that unfold in a world where truth is manipulated by media, clever lawyers, and public fascination with scandal.<\/p>\n<p class=\"wp-block-paragraph\">By being only an observer in the audience, it is easy to fall for their stories portrayed through the victim\u2019s eyes, who was merely responding to intolerable situations.<\/p>\n<p class=\"wp-block-paragraph\">Logically, there is a scientific explanation for why blame-shifting feels satisfying. Attributing negative events to external causes (other people or situations) <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC8019091\/#:~:text=choosing%20a%20self-serving%20attribution%20is%20a%20selection%20of%20the%20highest%20rewarding%20alternative\" rel=\"noreferrer noopener\" target=\"_blank\">activates brain regions associated with reward processing<\/a>. If it feels good, it reinforces the behaviour and makes it more automatic.<\/p>\n<p class=\"wp-block-paragraph\">This interesting play of blame-shifting is in the theatre of life now, where humans can also start calling out the <strong>tools powered by LLMs<\/strong> for poor decisions and life outcomes. Probably pulling out the argument of\u2026<\/p>\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/www.google.com\/search?q=They+had+it+coming%2C+they+had+it+coming+all+along.+I+didn%27t+do+it.+But+if+I%27d+done+it%2C+how+could+you+tell+me+that+I+was+wrong%3F&amp;oq=They+had+it+coming%2C+they+had+it+coming+all+along.+I+didn%27t+do+it.+But+if+I%27d+done+it%2C+how+could+you+tell+me+that+I+was+wrong%3F&amp;gs_lcrp=EgZjaHJvbWUyBggAEEUYOTIHCAEQIRiPAtIBBzM0OGowajeoAgCwAgA&amp;sourceid=chrome&amp;ie=UTF-8#wptab=si:APYL9btOMaxI48tKjOYdlPW3RyBplN8gAQzBdTKkB2IKbJ7kM9T8RmW6e56f40nA_2X21d_bbkniWhvX_3b8pp8zv0AIUx1EUR-9H61jxx1Qc0JSbemwRhiyqxd39ZQ2mmjlmbTYH7X5JwEAzRa6lKuJYzzTnY9M_NVZI8tyy_yynDs7MXmmcoI=:~:text=I%20guess%20you%20could%20say%20we%20broke%20up%20because%20of%20artistic%20differences\" target=\"_blank\" rel=\"noreferrer noopener\">Artistic differences<\/a><\/h3>\n<p class=\"wp-block-paragraph\">Knowing how the differences (artistic or not) lead us to justify our bad acts and shift blame to others, it\u2019s only common sense to assume we will do the same to AI and the models behind it.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">When searching for a responsible party for AI-related failures, one paper, \u201c<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/39693294\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>It\u2019s the AI\u2019s fault, not mine<\/em><\/a><em>,<\/em>\u201d reveals a pattern in how humans attribute blame depending on who\u2019s involved and how they\u2019re involved.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The research explored two key questions:\u00a0<\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">(1) Would we blame AI more if we saw it as having human-like qualities?<\/li>\n<li class=\"wp-block-list-item\">(2) And would this conveniently reduce blame for human stakeholders (programmers, teams, company, governments)?<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Through three studies conducted in early 2022, before the \u201cofficial\u201d start of the generative AI era through UI, the research examined how humans distribute blame when AI systems commit moral transgressions, such as displaying racial bias, exposing children to inappropriate content, or unfairly distributing medical resources and found the following:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">When AI was portrayed with more human-like mental capacities, participants were more willing to point fingers at the AI system for moral failures.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Other findings were that not all human agents got off the hook equally:\u00a0<\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">\n<strong>Companies<\/strong> benefited more from this blame-shifting game, receiving less blame when AI seemed more human-like.<\/li>\n<li class=\"wp-block-list-item\">Meanwhile, <strong>AI programmers, teams, and government regulators <\/strong>didn\u2019t experience reduced blame regardless of how mind-like the AI appeared.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">And probably the most important discovery:\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Across all scenarios, AI consistently received a smaller percentage of blame compared to human agents, and the <strong>AI programmer or the AI team <\/strong>shouldered <strong>the heaviest blame<\/strong>\u00a0burden.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">How were these findings explained?\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The research suggested it\u2019s about <strong>perceived roles and structural clarity:<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">\n<strong>Companies<\/strong> with their \u201ccomplex and often opaque structures\u201d benefit from reduced blame when AI appears more human-like. They can more easily distance themselves from AI mishaps and shift blame to the seemingly autonomous AI system.<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Programmers<\/strong> with their direct technical involvement in creating the AI features remained firmly accountable regardless of AI anthropomorphisation. Their \u201cfingerprints\u201d on the system\u2019s decision-making architecture make it nearly impossible for them to claim \u201cthe AI acted independently.\u201d<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Government entities<\/strong> with their regulatory oversight roles maintained steady (though lower overall) blame levels, as their responsibilities for monitoring AI systems remained clear regardless of how human-like the AI appeared.\u00a0<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">This \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/Scapegoating\" rel=\"noreferrer noopener\" target=\"_blank\">moral scapegoating<\/a>\u201d suggests corporate accountability might increasingly dissolve as AI systems appear more autonomous and human-like.<\/p>\n<figure class=\"wp-block-image\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/contributor.insightmediagroup.io\/wp-content\/uploads\/2025\/05\/0VrvA1gWvVgeUgZgj.jpg?ssl=1\" alt=\"\" class=\"wp-image-603489\"><figcaption class=\"wp-element-caption\">Moral scapegoating is defined in the study as the process of blaming an individual or group for a negative outcome to deflect personal or collective responsibility. [Photo by <a href=\"https:\/\/unsplash.com\/@photoframiac?utm_source=medium&amp;utm_medium=referral\" rel=\"noreferrer noopener\" target=\"_blank\">Vaibhav Sanghavi<\/a> on <a href=\"https:\/\/unsplash.com\/?utm_source=medium&amp;utm_medium=referral\" rel=\"noreferrer noopener\" target=\"_blank\">Unsplash<\/a>]<\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">You would now say, this is\u2026\u00a0<\/p>\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/All_That_Jazz_%28song%29#:~:text=cynical%20comment%20on%20the%20willingness%20of%20humans...to%20act%20solely%2C%20simply%2C%20and%20remorselessly%20in%20their%20own%20interest\" target=\"_blank\" rel=\"noreferrer noopener\">All that\u00a0jazz<\/a><\/h3>\n<p class=\"wp-block-paragraph\">Scapegoating and blaming others occur when the stakes are high, and the media usually likes to position a big headline, with the villain:\u00a0<\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">\n<a href=\"https:\/\/www.reuters.com\/legal\/new-york-lawyers-sanctioned-using-fake-chatgpt-cases-legal-brief-2023-06-22\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>\u201cNew York lawyers sanctioned for using fake ChatGPT cases in legal brief<\/em><\/a><em>\u201d<\/em>\n<\/li>\n<li class=\"wp-block-list-item\">\n<a href=\"https:\/\/scalebytech.com\/cursor-ai-chatbot-invents-fake-policy-sparks-developer-outrage\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>\u201cCursor AI Chatbot Invents Fake Policy, Sparks Developer Outrage<\/em><\/a><em>\u201d<\/em>\n<\/li>\n<li class=\"wp-block-list-item\">\n<em>\u201c<\/em><a href=\"http:\/\/tovima.com\/society\/greek-woman-divorces-husband-after-chatgpt-predicted-he-would-cheat-on-her\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Greek Woman Divorces Husband After ChatGPT \u2018Predicted\u2019 He Would Cheat on Her!<\/em><\/a><em>\u201d<\/em>\n<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">From all these titles, you can instantly blame the end-user or developer because of a lack of knowledge of how the new tools (yes, <a href=\"https:\/\/medium.com\/ai-advances\/the-good-enough-truth-c7cb2e633799#:~:text=a%20tool.-,A%20tool%20that%20can%E2%80%99t%20understand.,-A%20tool%20that\" target=\"_blank\" rel=\"noreferrer noopener\">tools<\/a>!) are built and how they should be used, implemented or tested, but none of this helps when the damage is already done, and someone needs to be held accountable for it.<\/p>\n<p class=\"wp-block-paragraph\">Talking about accountability, I can\u2019t skip the <a href=\"https:\/\/artificialintelligenceact.eu\/high-level-summary\/\" rel=\"noreferrer noopener\" target=\"_blank\">EU AI Act<\/a> now, and its regulatory framework that is placing on the hook AI <a href=\"https:\/\/www.ibm.com\/think\/topics\/eu-ai-act#:~:text=Subscribe%20today-,Who%20does%20the%20EU%20AI%20Act%20apply%20to%3F,-The%20EU%20AI\" rel=\"noreferrer noopener\" target=\"_blank\"><em>providers<\/em>, <em>deployers<\/em> and <em>importers<\/em><\/a>, by stating how:\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cUsers (deployers) of high-risk AI systems have some obligations, though less than providers (developers).\u201d<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">So, among others, the Act explains <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/library\/commission-publishes-guidelines-ai-system-definition-facilitate-first-ai-acts-rules-application#:~:text=The%20AI%20Act%2C%20which%20aims,those%20subject%20to%20transparency%20obligations.\" rel=\"noreferrer noopener\" target=\"_blank\">different classes of AI systems<\/a> and categorises <strong><em>high-risk AI systems<\/em><\/strong> as those used in critical areas like hiring, essential services, law enforcement, migration, justice administration, and democratic processes.<\/p>\n<p class=\"wp-block-paragraph\">For these systems,<em> providers<\/em> must implement a <a href=\"https:\/\/artificialintelligenceact.eu\/article\/9\/\" rel=\"noreferrer noopener\" target=\"_blank\"><strong>risk-management system<\/strong><\/a> that identifies, analyses, and mitigates risks throughout the AI system\u2019s lifecycle.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">This extends into a mandatory <a href=\"https:\/\/artificialintelligenceact.eu\/article\/17\/\" rel=\"noreferrer noopener\" target=\"_blank\"><strong>quality management system<\/strong><\/a> covering regulatory compliance, design processes, development practices, testing procedures, data management, and post-market monitoring. It must include \u201c<a href=\"https:\/\/artificialintelligenceact.eu\/article\/17\/#:~:text=an%20accountability%20framework%20setting%20out%20the%20responsibilities%20of%20the%20management%20and%20other%20staff\" rel=\"noreferrer noopener\" target=\"_blank\"><em>an accountability framework setting out the responsibilities of management and other staff.<\/em><\/a>\u201d<\/p>\n<p class=\"wp-block-paragraph\">On the other side, <a href=\"https:\/\/artificialintelligenceact.eu\/article\/26\/\" rel=\"noreferrer noopener\" target=\"_blank\"><em>deployers<\/em> of high-risk AI systems<\/a> need to implement appropriate technical measures, ensure human oversight, monitor system performance, and, in certain cases, conduct f<a href=\"https:\/\/artificialintelligenceact.eu\/article\/27\/\" rel=\"noreferrer noopener\" target=\"_blank\">undamental rights impact assessments<\/a>.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">To sweeten this up, <a href=\"https:\/\/artificialintelligenceact.eu\/article\/99\/\" rel=\"noreferrer noopener\" target=\"_blank\">penalties for non-compliance<\/a> can result in a fine of up to \u20ac35 million or 7% of global annual turnover.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Maybe you now think, \u201c<em>I\u2019m off the hook\u2026I am only the end-user, and all this is none of my concern<\/em>\u201d, but let me remind you of the already existing headlines above, where no lawer could <a href=\"https:\/\/www.youtube.com\/watch?v=8ZYG2PCyNfE&amp;ab_channel=BingeSociety\" target=\"_blank\" rel=\"noreferrer noopener\">razzle dazzle<\/a> a judge into believing innocent for leveraging AI in a work situation that seriously affected other parties.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Now that we\u2019ve clarified this, let\u2019s discuss how everyone can contribute to the AI responsibility circle.<\/p>\n<figure class=\"wp-block-image\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/contributor.insightmediagroup.io\/wp-content\/uploads\/2025\/05\/0548JZlCdnc417nyw.png?ssl=1\" alt=\"\" class=\"wp-image-603488\"><figcaption class=\"wp-element-caption\">\u201cYou are a 10x hacker and it must be someone else\u2019s fault.\u201d [Image source: <a href=\"https:\/\/orlybooks.com\/books\/blaming-the-user\" target=\"_blank\" rel=\"noreferrer noopener\">LINK<\/a>. The image is sourced from free online distribution.]<\/figcaption><\/figure>\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/www.youtube.com\/watch?v=3t6_odu4lNc&amp;ab_channel=Miramax\" target=\"_blank\" rel=\"noreferrer noopener\">When you\u2019re good to AI, AI\u2019s good to\u00a0you<\/a><\/h3>\n<p class=\"wp-block-paragraph\">True responsibility in the AI pipeline requires personal commitment from everyone involved, and with this, the best you can do is:<\/p>\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">\n<strong>Educate yourself on AI: <\/strong>Instead of blindly relying on AI tools, learn first how they are built and <a href=\"https:\/\/medium.com\/ai-advances\/did-we-skip-on-machine-learning-d8893d88a02a\" target=\"_blank\" rel=\"noreferrer noopener\">which tasks they can solve<\/a>. You, too, can classify your tasks into different criticalities and understand where it is crucial to have humans deliver them, and where AI can step in with <a href=\"https:\/\/learn.microsoft.com\/en-us\/semantic-kernel\/frameworks\/process\/examples\/example-human-in-loop?pivots=programming-language-python\" target=\"_blank\" rel=\"noreferrer noopener\">human-in-the-loop<\/a>, or independently.\u00a0<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Build a testing system<\/strong>: Create personal checklists for cross-checking AI outputs against other sources before acting on them. It\u2019s worth mentioning here how a good approach is to have more than one testing technique and more than one human tester. (What can I say, \u200ablame the <a href=\"https:\/\/www.practitest.com\/resource-center\/blog\/software-testing-best-practices-checklist\/\" target=\"_blank\" rel=\"noreferrer noopener\">good development practices<\/a>.)\u00a0<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Question the outputs (always, even with the testing system)<\/strong>: Before accepting AI recommendations, ask \u201cHow confident am I in this output?\u201d and \u201cWhat\u2019s the worst that could happen if this is wrong and who will be affected?\u201d<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Document your process<\/strong>: Keep records of how you used AI tools, what inputs you provided, and what decisions you made based on the outputs. If you did everything by the book and followed processes, documentation in the AI-supported decision-making process will be a critical piece of evidence.\u00a0<\/li>\n<li class=\"wp-block-list-item\">\n<strong>Speak up about concerns<\/strong>: If you notice problematic patterns in the AI tools you use, report them to the relevant human agents. Being quiet about AI systems malfunctioning is not a good strategy, even if you caused part of this problem. However, reacting on time and taking responsibility is the long-term road to success.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Finally, I recommend <strong>familiarising yourself with the regulations<\/strong> to understand your rights alongside responsibilities.
