Last month, a different judge <a href=\"https:\/\/sponsors.aha.org\/rs\/710-ZLL-651\/images\/2025-05-15_340B_Rebate_Models_Ruling\">reached<\/a> the same decision in lawsuits brought by Eli Lilly, Bristol Myers Squibb, and Novartis.<\/p>\n<p>\u201cBased on the plain and unambiguous language of the 340B statute, and supported by its purpose and history, HRSA has the authority to provide for discounts, rebates, or both.
